Legal Process Guidelines

These guidelines are intended for use by law enforcement agencies when requesting information from ZUKKA.

What is ZUKKA

ZUKKA is an independent collaboration platform that allows customers to establish secure professional networks for exchanging messages and files. Senders have the authority to determine who can access their messages and when they expire. Encrypted messages are stored on our servers temporarily and are deleted after being downloaded to the recipient’s device(s). We do not hold plaintext copies of the content shared through our system nor the keys to decrypt customer messages. Because ZUKKA’s business tools are intended for use in secure professional settings, each customer network is managed by the customer’s administrator, who can invite users both within and outside of the network.

ZUKKA complies with valid and binding legal processes issued in accordance with U.S. law and can only provide non-content subscriber information. Requests for customer account information from U.S. law enforcement must be properly served to ZUKKA.

Required Legal Process

ZUKKA will not release customer information without a valid and binding legal demand properly served on us, such as a subpoena, search warrant, or other legal process. ZUKKA objects to overbroad or otherwise inappropriate demands as a matter of course.

Method of Service

ZUKKA does not accept subpoenas, search warrants, or other legal processes except through the ZUKKA Law Enforcement Request portal at https://www.zukka.app/LER/. Legal documents must be served by uploading the appropriate documentation to this portal.

Access to the Law Enforcement Application Portal

To gain entry to the Law Enforcement Application Portal, users must possess valid login credentials. These credentials are issued by ZUKKA and provided to the appropriate authorities upon request. Access is granted after thorough communication with us, along with necessary documentation and certification.

Other Information

Preservation: Upon receiving a lawful and binding request, ZUKKA will retain the requested information for a period of up to 90 days.

Emergencies: ZUKKA reserves the right to promptly address urgent law enforcement requests in situations involving threats to public safety or potential harm to individuals. These requests must be submitted through the ALERT system by selecting the emergency request button. During an emergency, ALERT will provide law enforcement with temporary access to the relevant accounts.

Reimbursement: ZUKKA may request reimbursement for expenses incurred in responding to law enforcement requests for information, especially if those costs arise from handling particularly burdensome or unique requests.

Contents of Communications Are Not Available

Our system is designed to safeguard our customers’ privacy, and as a result, ZUKKA does not have access to decrypted message content. Any customer content stored on ZUKKA’s system remains encrypted and unreadable.

What Must Be Included in Account Information Requests?

Requests for customer information from law enforcement or other government entities must include:

• Identifying details for the account in question, such as User ID or Nickname; and
• A description of the specific information being sought.

Will ZUKKA Notify Customers of Requests for Account Information?

No, ZUKKA will not notify customers about requests for account information, as it only notifies customers if it discloses content information. Since ZUKKA does not have access to such content, no notifications are issued.

What Information Does ZUKKA Store?

ZUKKA maintains the following information about user accounts:

• Network affiliation
• ZUKKA nickname
• Email address (if provided)
• Phone number (if provided)
• Date of account creation
• Type(s) of device(s) used with the account
• Date of last use
• Total number of sent and received messages
• Avatar/profile image (if the user chose to provide one)
• Limited records of recent account setting changes, such as adding or suspending a device (excluding message content, routing, and delivery information)
