Legal Process Guidelines
These guidelines are intended for use by law enforcement agencies when requesting information from Smartago.
What is Smartago
Smartago LLC (hereafter referred to as “Smartago“) is a software development company that creates secure and innovative applications for various users. Our solutions are designed to prioritize privacy and security, ensuring user trust. For services such as Zukka and others developed by Smartago, we adhere to strict privacy principles and comply with legal processes as required by U.S. law.
Required Legal Process
Smartago will only release customer information in response to a valid and binding legal demand properly served on us, such as a subpoena, court order, or search warrant. Smartago objects to overly broad, vague, or otherwise inappropriate demands as a standard practice.
Method of Service
Smartago does not accept legal documents via email, mail, or fax. Legal demands must be submitted via the designated Smartago Legal Request Portal at www.smartago.net/LRP. Documents submitted through other channels will not be processed.
Access to the Legal Request Portal
Authorized law enforcement agencies must request access credentials for the Smartago Legal Request Portal. Credentials will be issued after verifying the requestor’s identity and authority.
Preservation of Information
Upon receiving a lawful and binding preservation request, Smartago will retain the requested information for up to 90 days, pending receipt of proper legal process for disclosure.
Emergencies
In cases involving imminent threats to public safety or potential harm to individuals, Smartago may expedite requests from law enforcement. Such emergency requests must be submitted through the portal with clear justification for their urgency.
Reimbursement
Smartago may seek reimbursement for costs incurred in processing complex or unique legal requests, as permitted by law.
Content of Communications Not Accessible
Smartago’s privacy-first architecture ensures that, for services like Zukka, user communications are encrypted end-to-end. This means Smartago does not have access to message content or decryption keys. Any stored content remains encrypted and inaccessible to Smartago.
What Must Be Included in Account Information Requests?
Requests for user account information must include:
• Specific identifying details such as a User ID, nickname, or account email address.
• A detailed description of the information being sought.
Will Smartago Notify Customers of Requests for Information?
Smartago does not notify customers of legal requests unless required to do so by law. Since Smartago does not access user content, no notifications will be issued regarding the disclosure of such information.
What Information Does Smartago Store?
The specific information stored depends on the service. Generally, Smartago may retain:
• Account creation details (e.g., date, email address, phone number).
• Limited technical data (e.g., device type, date of last use).
• Aggregated or anonymized usage metrics.
Smartago’s systems do not store unencrypted content or metadata related to user communications for its privacy-focused services.
